    Induced into signing contracts, lawsuit possible?

    I am a business customer with Rogers.

    When I was picking cell phone companies back in June 2011, I was deciding between Rogers and Bell. At that point both company's offers were similar so I could've gone with either companies.

    However, the sales rep at Rogers made me an offer I thought made the tip on the scale. I was promised that when I sign a 3 year contract with them (I had 3 lines) I would be able to pick up phones within the contract period without extending my contract term. I agreed to 3 year terms with Rogers on all 3 phones (+data) based on this agreement. I picked up phones with no problem during the time, and while I was charged extra per phone, I thought that was the cost of admin so I didn't look into it much. (Later I found out it was the cost to "upgrade my cell phone")

    Fast forward to a month ago, I called in to check for contract renewal dates to plan for the renewal. At this point, I found out that the contract dates on the lines were now different, one dating as late as a year ago when I picked up the last phone on the account.

    I called in asked to have the issue resolved, and the rep at that point told me he couldn't. So I asked to speak to a manager. I was promised a call back within a week, and a month passed, no call back. So I called back again. This time, I spoke with a rep that actually had the call back setup.

    I missed the first call back. On the voice mail, the manager sped through her number at 6 digits a millisecond. Needless to say I got none of it, so I couldn't call back.

    A week later, a manager called back again. I picked up this time. The manager just straight out didn't listen to what I was saying, and continued to explain the same thing over and over, and basically said what i was telling her was not possible, and to me it felt like from what she was saying. she was hinting that I was either making this up or lying. Needless to say I was not happy. I thought of taking my losses and just move my lines out of Rogers, and maybe preparing a lawsuit to sue for inducement and to recover my losses.

    I asked to be transferred to customer relations to find out my cost for cancellation, she mentioned that she cannot transfer me, and that I need to call in myself. (At this point, I think she just didn't want to do it) I agreed to call in myself.

    I got the number from her and I called customer relations. I got a really nice lady that was able to explain how things worked, and why what i was asking for (fix the issue by re consolidate the contract dates) was impossible to be done. She also chuckled at the point I made about how people are induced into contracts, being promised things the reps knew they couldn't do, and the many years she's been there she's seen numerous cases of things like this. (not going to disclose too much about her so she doesn't get in trouble) She also mentioned that the managers will not help cases like this.

    During the different calls. I was getting at least 2-3 different dates for contract end, on EACH line, at one point I was even told that I wasn't on contract for one or two lines and that I could make the renewal there and take a phone (talk about the lack of training...)

    Anyway, I am wondering if there is something that can be done to escalate my complaint, or if not, I am wondering if I have a legal case on my hands. What was said would've been in the recorded conversation I had with the rep when I initially agreed to the contract. I haven't talked to the lawyers yet, but I imagine I would be suing for remedies to put me back in the original condition as where I would've been when I was induced into agreeing to the original contract. Thoughts?

    If they are only kept for 1 year then they wouldn't have that recording anymore. I suppose one of the follow ups maybe... I will look into the route to complain to the CCTS

    Since the rep knows the calls are recorded, she's either looking to get fired or you are embellishing. Which is it?

    Or she was just an honest rep, as difficult as that may be to believe. That and she realizes that her specific call is unlikely to be reviewed, and if she is fired for being honest about such a trivial matter then she probably is better off.

    there is no rule saying i can not comment on a post of any certain age right? so thats a mute point.
    Commenting on a post means im contributing info, telling you that you can say NO when asked if you want a contract is a valid repsonse, some people dont know this, but after reading they do.
